General terms and conditions

GENERAL TERMS AND CONDITIONS FOR THE USE OF SERVICES AND PARTICIPATION IN EVENTS/SEMINARS ORGANIZED BY HELICAL DYNAMIX® LTD.

CHAPTER I – GENERAL PROVISIONS

1. HELICAL DYNAMIX® LTD., UIC 204492914, with registered office and registered address at: Sofia 1680, Krasno Selo residential district, 11 Poduevo Street, Entrance B, Floor 5, Apartment 24, hereinafter referred to as the “Company”, organizes seminars and events aimed at the personal and career development of individuals, as well as at improving and strengthening relationships within companies, both vertically and horizontally.

2. Participants in the seminars and/or events may be natural persons and/or legal entities that have accepted these General Terms and Conditions, hereinafter referred to as the “General Terms and Conditions”, as well as the rules for the specific event or seminar published on the Company’s website.

3. When registering for an event or seminar, the registration form provides for one individual admission ticket granting access to the event premises announced in advance.

3.1. For a one-day event or seminar, registration includes attendance on the day of the event or seminar, as well as all details and services described in advance in the registration form, according to the price and/or package selected by the Participant.

3.2. Where a price is announced for a two-day event or seminar, the stated price includes attendance on both days, as well as all details and services described in advance in the registration form, according to the price and/or package selected by the Participant.

3.3. The price of the event or seminar does not include accommodation or transportation expenses, which shall be borne by the Participants.

CHAPTER II – APPLICATION FOR PARTICIPATION / WITHDRAWAL FROM PARTICIPATION

1. Application for participation

1.1. Information about each event or seminar is published on the Company’s website, www.helicaldynamix.net, including the relevant price that the Participant must pay to the Company in order to participate.

By completing a registration form, the Participant agrees to comply with these General Terms and Conditions governing registration for and participation in events and seminars organized by HELICAL DYNAMIX® LTD.

1.2. A Participant applies to participate in an event or seminar by completing the registration form published on the Company’s website.

1.3. Where separate prices for early and late registration, as well as special offers linked to deadlines for payment of the full amount, are published on the website, the Participant is responsible for monitoring the applicable deadlines and paying the announced amount before the relevant deadline expires.

1.3.1. Early registration means registration completed before the deadline announced on the event website, provided that the full participation fee is paid by that date.

1.3.2. Late registration means:

  1. registration completed after the announced early-registration deadline; or
  2. registration completed before the early-registration deadline where the Participant is unable to pay the full amount by the relevant deadline.

1.4. Early-registration prices apply where the Participant has declared that they are able to pay the relevant amount within the deadline announced in advance on the website for the event or seminar for which they are registering.

1.5. Where the Participant is unable to pay the announced early-registration fee within the deadline published on the website, they shall be considered a late-registration Participant and shall pay the announced late-registration price.

1.6. Where a Participant has completed an early registration, the Company shall issue an invoice for the amount due under the early-registration conditions.

However, where the Participant fails to pay the invoice within the announced deadline, the Company shall issue and send a new invoice based on the late-registration price and shall set a new deadline for payment of the amount due.

2. Participation in an event or seminar

2.1. Payment of the participation fee entitles the Participant to actively attend the relevant event or seminar.

2.2. Participants must comply with the programme of the event or seminar announced in advance, any additional instructions issued by the Company, and any instructions issued by the fire-safety personnel concerning order and safety within the premises where the event or seminar is held.

3. Withdrawal from participation

3.1. Where a Participant withdraws from an event or seminar up to 30 working days before the date of the event, the Company shall refund 100% of the amount paid by the Participant upon registration.

3.2. Where a Participant withdraws from an event or seminar up to 14 working days before the date of the event, the Company shall refund 50% of the amount paid by the Participant upon registration.

3.3. Where a Participant withdraws from an event or seminar after the deadlines set out above in Clauses 3.1 and 3.2, the amount paid by the Participant upon registration shall not be refunded.

CHAPTER III – PERSONAL DATA PROTECTION

1. HELICAL DYNAMIX® LTD. is a personal data controller within the meaning of the Bulgarian Personal Data Protection Act and carries out its activities in accordance with the provisions of that Act, its implementing regulations, and the rules of the Code of Ethics for Personal Data Controllers adopted by the Commission for Personal Data Protection.

2. “Personal Data” means any information relating to an identified natural person or to a natural person who can be identified, hereinafter referred to as the “Data Subject”.

For the purposes of these General Terms and Conditions, “Personal Data” includes any information provided by the User when using the website, including, but not limited to, information submitted through a registration form for an event or seminar, as well as any other information that, either independently or in combination with other information, enables the identification of the User.

3. All Personal Data received by the Company in connection with the participation of natural persons in organized events and/or seminars shall be processed in accordance with the applicable legislation.

The Personal Data may be disclosed to third parties associated with the Company that act as data processors on behalf of the Company, including service providers such as providers of IT services, hosting, accounting, communication and organizational services, to the extent necessary for the performance of contractual relations with Participants or compliance with a legal obligation.

The Company ensures that appropriate agreements complying with the applicable legislation are concluded with all data processors and that such agreements provide an adequate level of protection for Personal Data.

Data processors are not entitled to use the Personal Data provided to them for any purposes other than those expressly assigned to them by the Company.

4. HELICAL DYNAMIX® LTD. undertakes to protect the confidentiality of information containing Personal Data provided by Participants through completed registration applications.

5. HELICAL DYNAMIX® LTD. undertakes to protect the confidentiality of information containing Personal Data provided by website users through completed registration applications for organized events, seminars, panel discussions and/or any other activity requiring prior registration by users.

Such information may include names, email addresses, telephone numbers and other Personal Data.

6. By accepting these General Terms and Conditions, the Participant acknowledges that their Personal Data shall be collected, processed and stored for the purposes of performing a contract or in the context of pre-contractual relations, namely participation in events and/or seminars organized by the Company, in accordance with Article 6(1)(b) of Regulation (EU) 2016/679.

6.1. Purposes of Personal Data processing

Personal Data may be processed for the following purposes:

  • identifying Participants;
  • managing and processing applications for participation in events and seminars;
  • organizing and conducting events, seminars and other activities;
  • communicating with Participants in relation to the services provided;
  • preparing proposals for the conclusion of contracts and performing contractual obligations;
  • issuing and administering accounting documents, including invoices;
  • providing comprehensive customer service and support, including processing inquiries and reports;
  • retaining correspondence related to the provision of services;
  • sending notifications related to the Company’s services;
  • preventing and detecting unlawful actions or actions that breach these General Terms and Conditions;
  • improving the quality of the services and the functionality of the website.

6.2. Categories of Personal Data processed by the Company on this basis

The Company may process the following categories of Personal Data:

  • contact details, including a contact address, email address and telephone number;
  • identification details, including names;
  • correspondence relating to the overall customer service and provision of services by the Company.

6.3. Personal Data retention periods

The Company shall retain Personal Data for no longer than is necessary to achieve the purposes for which it was collected, as follows:

  • Personal Data processed for the performance of a contract shall be retained for the duration of the contract and for up to five (5) years following its termination, unless the applicable legislation requires a longer retention period;
  • Personal Data contained in accounting documents shall be retained for the periods prescribed by the applicable tax and accounting legislation, generally for up to ten (10) years;
  • data relating to correspondence and customer service shall be retained for up to three (3) years following the completion of the relevant interaction;
  • data processed on the basis of a legitimate interest shall be retained until the relevant interest ceases to exist or until the Data Subject submits an objection, unless there are legal grounds for further retention.

Upon expiry of the applicable retention periods, the Personal Data shall be securely deleted or anonymized.

When their Personal Data is processed, Data Subjects have all the rights provided for in Articles 12 to 22 inclusive of Regulation (EU) 2016/679.

Where a Data Subject considers that HELICAL DYNAMIX® LTD. is in breach of the applicable data-protection legislation, they may contact the Company in order to seek clarification.

The Data Subject also has the right to lodge a complaint with the competent data-protection authority, namely:

CHAPTER IV – COOKIE POLICY

1. Use of cookies

1.1. “Cookies” are small text files or data packages stored through the internet browser on the User’s device, including a computer, tablet, laptop or mobile phone, when the User visits the website.

The main purpose of cookies is to recognize the User during subsequent visits, support the proper functioning of the website and improve the User’s experience.

1.2. The Company uses cookies for the following purposes:

  • ensuring the proper functioning of the website;
  • improving the website’s performance and functionality;
  • analyzing User behaviour and website traffic;
  • providing content and services tailored to Users’ interests.

Cookies that are not strictly necessary for the functioning of the website are used only after the User has provided prior consent through an appropriate mechanism, such as a cookie banner, in accordance with the requirements of Regulation (EU) 2016/679.

2. Types of cookies used by the Company

2.1. Necessary or essential cookies

These cookies are necessary for the proper functioning of the website and cannot be disabled through the website’s systems.

They are generally set in response to actions performed by the User, such as configuring privacy preferences or completing forms.

2.2. Analytical cookies

These cookies enable the Company to collect information about how Users interact with the website, including the number of visits, traffic sources and behaviour on individual pages.

The information collected may include online identifiers, such as IP addresses, and is used for statistical purposes and to improve the services.

2.3. Marketing cookies

These cookies are used to track User behaviour and display relevant content and advertisements.

2.4. Third-party cookies

The Company has no control over these cookies and recommends that Users review the privacy policies of the relevant third parties.

3. Retention period

3.1. The retention period of cookies depends on their type:

  • session cookies are stored temporarily and deleted when the browser is closed;
  • persistent cookies are stored for a specified period or until they are deleted by the User, but for no longer than two (2) years.

4. Cookie management

4.1. The User may manage the use of cookies through:

  • the settings of their internet browser;
  • the functionalities available through the website’s cookie banner.

4.2. The User may withdraw or modify their consent to the use of cookies at any time. This may affect the functioning of certain parts of the website.

CHAPTER V – OTHER CONDITIONS

1. Other conditions

1.1. Participants shall not be entitled to compensation where an event or seminar is postponed, cancelled or terminated as a result of force majeure within the meaning of Article 306 of the Bulgarian Commerce Act, namely an unforeseen or unavoidable event of an extraordinary nature occurring after registration and payment of the amount due.

1.2. Where the Company postpones an event to a new date for reasons or circumstances attributable to the Company, and the new date is not convenient for the Participant and the Participant is therefore unable to attend the event or seminar, the Company shall refund the full amount paid by the Participant upon registration.

1.3. Where the event is cancelled due to circumstances other than those specified in Clause 1.1, the Company shall refund the full amount paid by the Participants upon registration.

These General Terms and Conditions have been prepared by HELICAL DYNAMIX® LTD. and govern the relationship between the Company and the users of the website www.helicaldynamix.net, as well as the relationships arising from the provision of online services and the organization of events and seminars by HELICAL DYNAMIX® LTD.

Acceptance of these General Terms and Conditions is a prerequisite for accessing this website and successfully registering for any event or seminar organized by HELICAL DYNAMIX® LTD.

Each User is bound by these General Terms and Conditions throughout their use of the system, starting from their initial access to the HELICAL DYNAMIX® LTD. website.
